What is covered:
Service performed hereunder shall consist of (three year) parts and (three year) labor, and for M3 series at (five year) labor and (five year) parts necessary to restore your product to normal operating condition. The warranty coverage applies only to new and original Plextor products.
What is not covered:
Any loss or damaged resulting from any cause other than normal usage, such as, but not limited to loss or damage due to accidents, misuse, abuse, neglect, contamination, virus infection, mishandling, misapplication, alteration, faulty installation, set-up adjustments, misadjustment or consumer controls, improper site preparation or maintenance, connection to improper voltage supply, power line surge, lightning damage, or commercial use (such as in a hotel, office, restaurant, or other business), rental use of the products, or attempted repair, modification or service by anyone other than a Plextor’s service center or its authorized service facilities, or damage that is attributable to acts of God.
A. Hardware Limited Warranty

Plextor warrants to the end-user customer that the Plextor products included in this package will be free from defects in material and workmanship for the duration of 3 years or 5 years for M3 series SSD, which duration begins on the date of purchase by the customer. The customer is required to provide a proof of purchase as a condition of receiving warranty service.

For software products, Plextor’s limited warranty applies only to a failure to execute programming instructions. Plextor does not warrant that the operation of any product will be uninterrupted or error free.

Plextor’s limited warranty covers only those defects which arise as a result of normal use of the product, and does not cover any other problems, including those which arise as a result of:

a. Improper maintenance or modification;

b. Software, media, parts, or supplies not provided or supported by Plextor; or
-
c. Operation outside the product's specifications.

If Plextor receives, during the applicable warranty period, notice of a defect in any product which is covered by Plextor’s warranty, Plextor shall either repair or replace the defective product, at Plextor’s option. Replacement products and parts are warranted to be free from defects in material or workmanship for 90 days or, for the remainder of the applicable warranty period of the Plextor products, whichever is longer.

If your Plextor product has recurring failures during the warranty period, at Plextor’s option, Plextor may provide you a replacement of Plextor’s choosing that is the same or equivalent in performance.

Plextor shall have no obligation to repair, replace, until the customer returns the defective product to Plextor.

Any replacement product may be either new or like-new, provided that it has functionality at least equal to that of the product being replaced.

Plextor products may contain remanufactured parts, components, or materials equivalent to new in performance.

Before delivering the product for service under this warranty, it is customer’s sole responsibility to remove all data, including, without limitation, confidential data from the product. In addition, it is customer’s sole responsibility to backup or copy all of its data. Plextor is not responsible for any damage to or loss of any programs, data, or other information stored on any media contained within the product, or any data that may be lost or damaged during transit or repair. Recovery or reinstallation of programs, data or other information is not covered under this warranty.

Plextor requests that customer not to include accessories for the product (remote, battery, cables etc.) when sending the product to a Plextor service facility for warranty services. If accessories are sent to the Plextor service facility, Plextor cannot guarantee that they will be returned.

This warranty does not cover if the serial number is removed or tampered by anyone other than Plextor, and service is only available within the local country due to import/export requirements.
Plextor, at its sole discretion, may subcontract to or engage a third party to provide the warranty services provided for herein.
To the extent allowed by local law, neither Plextor nor its third party suppliers make any other warranty or condition of any kind, whether express or implied, with respect to Plextor products, and specifically disclaim the implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, or any other warranty with respect to the quality, accuracy or freedom from error of the operation, use and function of the product. If Plextor cannot lawfully disclaim or exclude implied warranties under applicable law, then to the extent possible any claims under such implied warranties shall expire on expiration of the express warranty period. Plextor does not warrant or represent that it will be able to repair any product under this without risk to or loss of programs or data.
C. Limitations of Liability
To the extent allowed by local law, the remedies provided in this Warranty Statement are the customer’s and exclusive remedies. To the extent allowed by local law, except for the obligations specifically set forth in this warranty statement, in no event shall Plextor or its third party suppliers be liable for direct, indirect, special, incidental, consequential damages, including claims for lost data, revenue, profits or business opportunity, any costs of recovering or reproducing any programs or data stored in or used with the product, and any failure to maintain the confidentiality of data stored on the product, whether based on contract, tort, or any other legal theory and whether the possibility of such damages.
